Welcome to the Lavender service! Our Terms and Conditions apply to the Lavender project, including our Lavender - Sleep and Relax application. Lavender (“Lavender,” “we,” “us,” and “our”) provides you access to its relaxation and online self-improvement website and application.

Together with any of the other documents mentioned herein, these Terms and Conditions set out the terms of use under which you may use our Service. Please, read these Terms and Conditions carefully and ensure that you understand them.

Using our Service, you will be required to read these Terms and Conditions when signing up for an account, purchase a Subscription, and accept these Terms. If you do not agree to comply with and be bound by these Terms and Conditions, you must stop using our Service immediately.

Intellectual Property

Our Service and associated content include, but are not limited to, all information, materials, images, graphics, video, audio, software, photographs, articles, functions, text, and other content contained, displayed, or reflected on the application or website, all copyrights, trademarks, and other intellectual property rights in or relating to the application content, are the exclusive property of Lavender, its licensors or content providers or other third parties

Access and Use

Using our Service, you agree to comply with all applicable federal, state, and local laws, including, without limitation, copyright law. Our Service is provided for your personal, non-commercial use only. We may offer certain parts of our Services free of charge and others for a fee. This can be done on a subscription basis or any other legal price structure. Lavender reserves all rights in and to the App not expressly granted to you under these Terms. You may not copy the app, except for making a reasonable number of copies for backup or archival purposes.

Except as expressly permitted in these Terms, you may not:

  • Modify, copy or create derivative works based on the App;

  • Distribute, transfer, sublicense, lease, lend or rent the App to any third party;

  • Reverse engineer, decompile or disassemble the App;

  • Make the functionality of the App available to multiple users through any means;

We may suggest, ask, or otherwise permit you to install or print Service Content in certain instances. In such case, you may do so only in the manner authorized and for your non-commercial use only. You acknowledge that you do not acquire any ownership rights by downloading, installing, or printing Service Content.

Besides, except as purposely permitted in these Terms, you may not:

  • Modify, delete, or hide any copyright, trademark, or other proprietary rights notices that we include in or through our Services or the Content of the Service;

  • Violate, disable or otherwise interfere with our security features, including any features that prevent or restrict the use or copying of any software or other Service Content;

  • Collect or receive any personal information from our Services, including usernames, passwords, and email addresses;

  • Invite other users to join or become a member of any commercial online service or other organization without our prior written permission;

  • Attempt or interfere with the proper functioning of our services, impair, overload, or disable them;

You fully agree to cooperate with us to investigate any suspected or actual activity breaking these Terms of Use.

Memberships and Subscriptions

General Membership Terms

In your use of our App, you may optionally create an Account. We can ask you to provide certain personalized information to us. When creating an account, your data must be accurate and complete. If any of your information changes later, it is your responsibility to ensure that your account is kept up to date.

By registering, you warrant that:

  • You are legally capable of entering into binding contracts;

  • All registration information you submit is truthful and accurate;

  • You will maintain the accuracy of such information;

  • Your use of the Service does not violate any applicable law or regulation;

It is your responsibility to keep your password safe. You must not share your account with anyone else. If you believe your account is being used without your permission, please contact us immediately. We will not be liable for any unauthorized use of your account.

Subscription

Lavender account holders may access the App in two ways:

  • Unregistered Free Use

    You may use our Service free of charge. You may, but are not required to, provide us with your name and email address in connection with such use. Notably, the Service will be limited to free use, and you will not have access to all of the content available to paid users.

  • Paid Subscription (“Lavender Premium”)

    Lavender offers a subscription fee-based program, which gives access to all content. Once you register for the paid subscription, you will be considered a Member of Lavender Premium. You will only have access to Lavender Premium while your subscription is active and subsisting. You may have access to a free trial period of Lavender Premium following certain promotional offers.

    You may access Lavender Premium by purchasing a subscription within the App. We offer monthly, 6-month, and annual subscription options. For our monthly and yearly subscriptions, a month constitutes 30 calendar days, and a year includes 365 calendar days.

    Lavender subscriptions are not transferable, and therefore you agree not to sell, transfer, or exchange memberships or subscriptions in any way or under any circumstance. This expressly applies to any discounted, subsidized, or free accounts or subscriptions.

    You may not register for more than one membership.

Refunds

Generally, all charges for purchases are nonrefundable, and there are no credits for partially used periods. You agree that any subscription ends with termination or discontinuation of the Service and that no refunds shall be issued in the event of discontinuation.

Please note that if you purchase a subscription through the Apple iTunes Store or Google Play, the sale is final, and we cannot provide a refund. In addition, your purchase will be subject to Apple’s or Google’s applicable payment policy, which may or may not allow refunds.

Cancelation of Services

You may cancel your account at any time by sending an email to us at support@lavender.live. Upon canceling your subscription, you will not receive a refund for the fees you already paid for your current Subscription Period. You will continue to receive the Services ordered until the end of your current Subscription Period.

Changes in Pricing

We reserve the right to change our subscription plans or change the pricing of our Service or any of its components in any manner and at any time as we may determine in our sole and absolute discretion.

Payment Method

Payment for Subscriptions will be due at the time of purchase. Your chosen payment method will be billed immediately upon confirmation of your subscription. The amounts due and payable by you for a transaction through the Service will be presented to you before you place your order.

When you purchase a Subscription, we may ask you to supply additional information relevant to your transaction, such as your credit card number, credit card expiration date, and your address for billing.

For each period that your subscription is active, you acknowledge and agree that Lavender is authorized to charge the payment method.

You agree to promptly notify Lavender of any changes to the payment method you provided while any subscriptions remain outstanding. Furthermore, you are responsible for all applicable charges incurred, including applicable taxes and all subscriptions purchased by you.

User Content & Third-Party Links

Our Service may contain user content intended only for educational, entertainment, and advertising purposes. You may not rely on any information or opinions expressed through our Service. We are not liable for any damages caused by your reliance on any user content.

In many cases, the content of the Service will include content hosted by a third party that provides links to content, such as websites and links on social networks. We do not manage, control or endorse the content found on these third-party sites. The provision of a link by Us is for reference only and does not imply any endorsement of the linked content or those in control of it.

Disclaimers

You agree that the use of our Service is at your sole risk. We make no representation or guarantee that our Service will meet your requirements. However, we make reasonable efforts to ensure that the content contained within our App is complete, accurate, and up-to-date.

Termination

Lavender reserves the right to terminate your account or your access to the application immediately, with or without notice to you and without liability to you, if we believe that you have breached any of our terms.

Copyright Policy

Since we respect the intellectual property rights of others, we hope that our users will do the same. Therefore, we may terminate or disable user membership if we suspect someone of copyright infringement or other intellectual property rights. We may also remove or disable access to materials that may infringe rights.

Dispute Resolution

Any dispute, proceedings, or claim between you and Us relating to these Terms and Conditions or the relationship between you and Us shall be subject to the jurisdiction of the courts of the United States.

You agree to contact us with disputes by contacting us at the address provided in these Terms of Use. We will contact you based on the contact information you have provided us.

If, after 30 days, the parties cannot resolve any dispute raised under the previous provision, the dispute may be submitted to the court.

Other Important Terms

Without our express written permission, you may not transfer your obligations and rights under these Terms and Conditions.

The contract is between you and Us. It is not intended to benefit any other person or third party in any way, and no such person or party will be entitled to enforce any provision of these Terms and Conditions.

Changes to these Terms and Conditions

We may alter these Terms and Conditions at any time. Any such changes will become binding on you upon your first use of our App after the changes have been implemented. You are therefore advised to check this page from time to time.
